Delivery

1. Unless the parties have agreed otherwise on the delivery time, the supplier delivers the goods by transferring the physical possession or control of the goods to the consumer without undue delay, but in any case within 30 calendar days of the conclusion of the contract.

2. Where the supplier fails to fulfill his obligation to deliver the goods at the time agreed with the consumer or within the time limit set out in paragraph 1, the consumer must ask him to deliver the goods within a further period of time appropriate to the circumstances. If the supplier does not deliver the goods within this additional period, the consumer is entitled to terminate the contract.

The first subparagraph shall not apply to sales contracts if the supplier has refused to deliver the goods or if the delivery within the agreed delivery time is significant, taking into account all the circumstances surrounding the conclusion of the contract or if the consumer has informed the supplier, prior to the conclusion of the contract, that delivery is required to take place on or until a certain date. In such cases, if the supplier fails to deliver the goods at the time agreed with the consumer or within the time limit specified above, the consumer is entitled to terminate the contract immediately.

3. Once the contract has been terminated, the supplier has to return, without undue delay, all the money paid under the contract.

4. The denunciation referred to in paragraph 2 shall be without prejudice to any consumer's legitimate right under the general provisions.

Expenses for use of payment instruments

It is forbidden for the supplier to charge consumers, for the use of a particular means of payment, an expense which exceeds the cost of using that means by himself.

Risk shifting

In contracts where the supplier sends the products to the consumer, the risk of loss or damage to the goods is passed on to the consumer when he or a third party designated by the consumer and other than the carrier has acquired the physical possession of the goods. However, the risk is passed on to the consumer upon delivery to the carrier if the carrier has been ordered by the consumer to transport the goods and the choice has not been offered by the supplier, without prejudice to the consumer's rights towards the carrier.
